Renewal

Monthly and annual fees will be billed automatically to the credit card designated during the registration process at the start of the monthly period, and will auto-renew until membership is terminated. If a User pays by credit card, MotionBased will automatically charge the monthly or annual fee to the User's supplied credit card and You authorize Us to charge such credit card for the appropriate subscription fees and amounts stated. MotionBased reserves the right to increase subscription fees or to institute new fees at any time, upon reasonable notice posted in advance on this Site. The renewal charges will be the same as the regular subscription fees as described above, unless otherwise notified in advance. Users may upgrade from MotionBased Lite to MotionBased Standard status at any time. The billing cycle is then based upon the day after MotionBased receives payment of the Standard fees. Users changing to annual subscriptions will have their new rates take effect at the beginning of the next billing date. Upgrading/adding additional categories will result in a new billing date effective upon the date of payment of the additional fees.

PLEASE NOTE THAT YOU WILL NOT RECEIVE A REFUND OR REIMBURSEMENT OF YOUR SUBSCRIPTION FEE AFTER YOUR SUBSCRIPTION HAS RENEWED.

Modifications

You may modify your subscription level, switch to a different credit card, and change your credit card information by logging in to your account and going to the "Modify Subscription" page under the "Account" section or contact us by telephone at (415) 339-0477 Monday through Friday between the hours of 9:00am and 5:00pm (PT).

Cancellation

You may cancel your subscription by logging in to your account and going to the "Cancel Subscription" page under the "Account" section or contact us by telephone at (415) 339-0477 Monday through Friday between the hours of 9:00am and 5:00pm (PT). If you wish to cancel your subscription outside regular business hours, please leave a message including your name, username, email address associated with your account and a telephone number where we can reach you to confirm.

Downgrades to a shorter payment plan or cancellation of any subscription will not result in any refund or credit of fees already paid. Subscription fees, whether paid monthly or annually, are charged up-front and no refunds or credits will be given upon cancellation. The cancellation of a subscription will go into effect at the end of your current billing cycle. Additional fees may apply if you decide to resubscribe at a later date.

Upon cancellation, you will have full access to your activities listed in the Digest through the remainder of your subscription term. When your subscription ends, your account will enter "MotionBased Lite" mode. You can continue to upload unlimited activities to MotionBased and have full access to your last 3 activities submitted. Since you always maintain access to the data stored in your account, you can renew your subscription at anytime without opening a new account.

• Violate any applicable law or regulation;
• Post or transmit any Content that You do not have the right to post or transmit under any law, contractual duty or fiduciary relationship;
• Post or transmit any Content that infringes a third party's intellectual property rights or rights of publicity or privacy;
• Post or transmit any Content that is unlawful, untrue, fraudulent, harassing, libelous, defamatory, abusive, tortuous, threatening, pornographic, harmful (including but not limited to viruses, corrupted files, or any other similar software or programs), overly disparaging or deprecating of MotionBased or other users or otherwise objectionable;
• Access, tamper with or use non-public or non-authorized areas of the Web Site. Unauthorized individuals attempting to access these areas of the Web Site may be subject to prosecution;
• Tamper with postings of other users;
• Post logos, seals or slogans from third parties on any part of the Web Site unless they are provided by MotionBased or a MotionBased partner;
• Solicit or gather any user's information available from the Web Site, such as other users' names and email addresses, for any commercial or business purposes or to transmit any unsolicited advertising, "junk mail", "Spam" or "chain letters;
• Do anything which would create or impose an unreasonable or disproportionately large burden or load on the Web Site;
• Post false or misleading information about a trek, event, product, service, etc.;
• Frame or link to the Web Site except as permitted in writing by MotionBased;
• Impersonate or misrepresent yourself or Your affiliation with any person or entity.
